Himachal Pradesh High Court banned plastic packing of Junk food

The Himachal Pradesh High Court on 26 December 2013 banned the junk food items in plastic packing and directed to implement the ban in the state from 26 January 2014.
The High Court cleared stay on the Himachal Pradesh government’s notification issued on 26 June 2013 imposing ban on sale, storage, entry, supply and manufacture of 25 junk items.
A division bench of Justice Rajiv Sharma and Justice V.K. Sharma directed the State Government 
• To implement the banning of the storage, supply, sale and entry of non-essential food items packaged in plastic or non-biodegradable material. It excludes drinking water both packaged and mineral.
• To ensure that  no foodstuff, including primary and essential food, is manufactured, transported, sold, packaged and distributed without conforming to the Food Safety and Standards Act of 2006 and Food Safety and Standards (Packaging and Labelling) Regulation of 2011
• Eatables like potato chips, cookies, candy, chewing-gum, ice-cream, chocolates and noodles would not be available in polythene packets
• To appoint a food commissioner, if not already appointed within four weeks should be appointed
• To ensure that no person is permitted to commence or carry on any food business without obtaining a license.
• All the municipal authorities in the state to manage the plastic waste by undertaking Waste audit frombeginning of the year.
The Order will be passed by the High Court further to ensure that edible oils shall not be sold in plastic bottles or pouches and shall be packed in tin containers from 31 March 2014.
